The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Section 6(4) of TN Scheduled Commodities (RDCS) Order, 1982 r/w Section 7(1)(a)(ii) of Essential Commodities Act, 1955 in Crime No.123 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. By order dated 28.08.2023, the petitioner along with A1 were found to be in possession of 450 kgs of PDS rice. This Court, while granting anticipatory bail to A2, taking note of the fact that there are four previous cases as against the petitioner (A1), has dismissed the anticipatory bail petition to the petitioner. This is the second anticipatory bail petition.

3. Today, the learned Government Advocate (Crl. side) appearing for the respondent would submit that the other accused were arrested and remanded to judicial custody, subsequently, they were granted statutory bail. Hence, he opposed for grant of anticipatory bail to the petitioner. RMT.TEEKAA RAMAN, J.

4. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl.side) appearing for the respondent.

5. After perusing the earlier order and the overtact against the petitioner, this Court finds that there is no change of circumstances.
