2. Mr.Jainulawuddin The Election Officer/Superintendent of WAKFS, O/o. The Superintendent of WAKFS, Salem.
....Respondents PRAYER: Contempt Petition is filed under Section 11 of Contempt of Courts Act, 1971, praying to punish the respondents for having willfully disobeyed the order dated 25.07.2023 passed in W.P.No.15076 of 2023. For Petitioner : M/s.L.Chandrakumar For respondent :M/s.Mohammed Faiyaz Ali Standing Counsel(WAKF) 1/4
ORDER
The contempt petition is filed mainly on the ground that the persons elected in the election pursuant to the impugned notification have not handed over the charge to the petitioner. In the order passed in the writ petition, the election notification has been quashed on the ground that the same is an internal affairs of the wakf. However, at the time of disposal of the main writ petition, it was not brought to the notice of the Court that the election was held pursuant to the impugned notification and new office bearers had taken charge. Therefore, no direction was issued to the office bearers to hand over the charge to the petitioner. Since there is no specific direction in the order, the act of contempt alleged against the respondents is of no substance. Further, the newly elected office bearers were not impleaded in the writ petition. Hence, the contempt petition is closed.
