This Petition has been filed directing the respondents 2 and 3 not to harass the petitioner.

2. It is the contention of the petitioner that the summons is issued by the third respondent on the basis of the FIR.No.212/2024, however, the petitioner is not an accused in the said FIR. Hence, seeks for a direction.

3. Heard both sides and perused the materials placed on record. Though, it is the contention of the petitioner that he is not arrayed as an accused, if the investigating officer deems it fit to call upon the petitioner for any enquiry relating to the case, it is for the investigating agency to issue appropriate notice to the petitioner under Section 35(3) of BNSS for enquiry and on such notice, the petitioner shall appear for enquiry and co-operate with the investigation.
