Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the respondent to treat the medical leave period of the petitioner between 21.03.2020 and 06.03.2024 as full duty period with consequential monetary and seniority benefits on the basis of the petitioner's representation, dated 13.12.2024. ORDER

This Writ Petition is filed for issuance of a writ of mandamus, directing the respondent to treat the medical leave period of the petitioner between 21.03.2020 and 06.03.2024 as full duty period with consequential monetary and seniority benefits on the basis of the petitioner's representation, dated 13.12.2024.

2. The case of the petitioner is that while he was working as Conductor in the respondent Corporation, met with a motor accident on 18.10.2017, due to which he was treated as Locomotor disabled person up to 60% disability and therefore, he availed medical leave from 21.03.2020 to 06.03.2024. In this regard, he submitted a representation, dated 13.12.2024, to the respondent to treat the said period as duty period with full benefits, however, the same has not been considered. Hence, he has come before this Court by way of this Writ Petition.

3. In view of the above, without going into the merits of the case, the respondent is directed to consider the representation of the petitioner, dated 13.12.2024, and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of copy of this order.

4. Writ Petition is disposed of accordingly. No costs.
