ORDER

The petitioner has filed this Writ Petition seeking for a Writ of Certiorarified Mandamus, to call for the records relating to the Tamil Nadu Gazette Notification dated 24.02.2021 in Page No.314, Column 4524 effecting the change of name of the minor child's initial from P.Arjun Shravan to M.Arjun Shravan and quash the same as being illegal, arbitrary, mala fide, and in violation of the statutory and constitutional rights of the petitioner and consequently direct the 2nd respondent to refrain from taking any actions relying on the Tamil Nadu Government Gazette on 24.02.2021, in page No.314, Column 4524 effecting the change of name of the minor child's initial from P.Arjun Shravan to M.Arjun Shravan.

2. Since no adverse order has been passed against the 2nd respondent, notice to the 2nd respondent is dispensed with.

3. Mr.P.Ganesan, learned Additional Advocate General, accepts Page No.2 of 6

notice on behalf of the 1st respondent. In view of the consent expressed by the learned counsel for the parties, this writ petition is taken up for final disposal at the stage of admission itself.

4. The case of the petitioner is that he married the 2nd respondent and out of their wedlock one Arjun Shravan was born. There was a matrimonial dispute between the petitioner and the 2nd respondent, thereby the 2nd respondent along with her son, was living separately. Since the petitioner was restrained by the school authorities to meet his son, he filed GWOP.No.1809 of 2019 on the file of the VI Additional Family Court, Chennai seeking to appoint him as the legal guardian and grant permanent custody of the minor child to the petitioner. Whileso, the 2nd respondent has change the initial of her son from 'P.Arjun Sharavan' to 'M.Arjun Shravan' and the same has been officially published in the Tamil Nadu Government Gazette on 24.02.2021. Challenging the same, the petitioner has filed the above writ petition before this Court.

5. Though very many grounds have been raised in this writ petition, however, at the time of arguments, learned counsel appearing for the petitioner restricted his prayer and sought permission of this Court to Page No.3 of 6

raise all his grievance before the court where the GWOP is pending.

6. In view of the limited request sought for by the learned counsel for the petitioner, this Court, without interfering with the impugned order, grants liberty to the petitioner to raise all his grievance in the GWOP filed by him.

7. With the above liberty, this Writ Petition is dismissed. It is made clear that this Court has not expressed any opinion on the merits of the matter. No costs. Consequently, the connected miscellaneous petitions are closed.
