Though learned counsel has been engaged for the respondents 1 to 4, none represents the respondents despite sufficient opportunities being granted.

2. This petition has been filed for condonation of delay of 569 days in preferring the First Appeal. The learned counsel for the petitioner took me through the affidavit filed in support of the application and also invited my attention to the E-Court's status, which incorrectly reflected that, as if the suit filed by the petitioner has been decreed without costs.

3. However, it was only much later that the petitioner came to know that a portion of the suit had been disallowed, specifically while the relief of permanent injunction was granted, other reliefs were denied. Hence, the petitioner was constrained to prefer the First Appeal. As the reasons assigned for the delay are acceptable and bona fide, I am inclined to allow this Civil Miscellaneous Petition.
