Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the respondents 1 to 6 to remove the encroachments made by respondents 7 to 10 in S.Nos.151/3, 152/1, 161/9 and 162/3 in the Gajacombai Village, Pottireddipatti Panchayat, Sendgamangalam Taluk, Namakkal District. ORDER
(Made by the Hon'ble Chief Justice) Heard Ms.V.Shri Varshini, learned counsel appearing for Mr.I.Abrar Md Abdullah, learned counsel for the petitioner, Mrs.R.Anitha, learned Special Government Pleader for respondents 1 to 3 and 5 and Mr.P.Muthukumar, learned State Government Pleader for respondent 4.
2. Learned counsel for the petitioner submits that in the year 2015 itself, the Tahsildar has stated that notice under Section 7 of the Tamil Nadu Land Encroachment Act, 1905 has been issued to remove the encroachers on all the encroachments including the patta holders in S.Nos.150, 151/1 and 161/9, however, till date, no action has been taken.
3. Learned State Government Pleader, on instructions, submits that fresh inspection would be done within a period of four weeks from today and depending upon the report of the inspection, if encroachments are found, further steps would be initiated within a period of four weeks thereafter.
4. In the light of the said submission, the writ petition, as such, stands disposed of. There will be no order as to costs. (S.V.G., CJ.) (D.B.C., J.) 12.12.2023 Index :
