The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 153(A), 505(2) and 506(i) of IPC in Crime No.129 of 2023, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner had posted provocative statements through social media in his instagram account with intent to promote enmity between two groups and he had disturbed public tranquility in Thirunallar.

3. Serious objections have been raised by the learned Public Prosecutor (Puducherry) wherein the nature of the statement has also been stated. It is also seen that there was a previous murder in that area and there were two groups, one supporting the accused and other the defacto complainant.

4. It is also stated that the petitioner has been promoting enmity between two groups. There are also 10 previous cases against the petitioner and he is a history sheeter in Thirunallar Police Station with more than 9 cases including under POCSO Act and NDPS Act. https://www.mhc.tn.gov.in/judis

vkr 5.Taking all the factors into consideration, I am not inclined to grant anticipatory bail to the petitioner.
