This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 700 days in filing the above Criminal Revision Case against the order dated 29.07.2021 passed in Crl.A.No. 05 of 2022, on the file of III Addl. District and Sessions Court, Tiruvallur.

2. Mr.R.Thirumoorthy, learned counsel for petitioner submitted that he ought to have filed within 90 days from the date of judgment, but after the conviction was passed, non-bailable warrant executed and he was arrested and detained as Convicted Prisoner. He would also submit that as he was unable to mobile the cheque amount, the petitioner is not able to instruct counsel on record to prefer the above Criminal Revision case and only during month of September 2025, he gave papers to him, as a result of which, there is a delay of 700 days in filing the above Criminal Revision Case arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Criminal Revision Case.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition. Registry is directed to number the Criminal Revision Case if it is otherwise found to be in order and post the matter on 26.09.2025.
