ORDER

The petitioner, who was arrested and remanded to judicial custody on 25.11.2024, for the offences punishable under Sections 125(2), 351(2), 332(c) of BNS r/w Sections 5(k), 6 of POCSO Act in Crime No.32 of 2023, registered on the file of the respondent police, seeks bail. 2.The case of the prosecution is that when the minor victim girl who is a deaf and dumb was alone in her house taking advantage of the situation, the petitioner sexually assaulted her. Hence, the parents of the defcto complainant has lodged a case against the petitioner. 3.The learned counsel appearing for the petitioner submitted that due to the previous enmity a false complaint has been lodged against the petitioner. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that this is the second bail application and 2/4

the earlier bail application in Crl.O.P.No. 20047 of 2025 was dismissed by this Court on 07.08.2025.

5. In view of the above facts and this is the second bail application and the earlier bail application in Crl.O.P.No. 20047 of 2025 was dismissed by this Court on 07.08.2025 and there is no change in circumstances, this Court is not inclined to grant bail to the petitioner.
