O R D E R
(through Video Conference) This Criminal Original Petition has been filed seeking for a relief, to transfer the investigation in Crime No.26 of 19 from the file of the second respondent to CBCID for proper investigation.
2.Heard Mr.S.Vijayakumar, learned Counsel for the Petitioner and Mr.S.Karthikeyan, learned Additional Public Prosecutor appearing for the respondents.
3.Today, when the petition is came up for hearing, the learned Additional Public Prosecutor appearing for the respondents, on instructions, would submit that in respect of https://hcservices.ecourts.gov.in/hcservices/
the petition mentioned crime number i.e., Crime No.26 of 2019, after securing the accused, now the investigation officer had examined twelve witnesses and recorded their statements. He would further submit that during the course of investigation, the fake receipts prepared by the accused were recovered and thereafter, steps have been taken for sending the same to obtain opinion from the handwriting expert.
4.On going through the status report filed by the investigation officer, it reveals the fact that investigation is going in correct path. At this juncture, the learned Counsel for the petitioner made a submission that though this petition has been filed for the relief of transferring the investigation, it would be suffice to direct the second respondent police to complete the investigation within a period as stipulated by this Court.
5.Hence, in view of the above, since already twelve witnesses have been examined on the side of the prosecution and considering the submissions made by the learned Counsel for the petitioner, the second respondent police is directed to file final report in Crime No.26 of 2019 within a period of three months from the date of receipt of a copy of this order and accordingly, this Criminal Original Petition is disposed of.
