The petitioner/A4, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 126(2), 296(b), 115(2), 118(1), 351(2) and 109 of BNS, 2023, in Crime No.188 of 2024, on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that due to previous enmity, on 03.07.2024 at about 8.00 p.m., the petitioner along with the other accused, waylaid the defacto complainant, abused him in filthy language and assaulted him with knife and iron rod, due to which the defacto complainant sustained grievous injuries. Hence, the case.
3. Learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that there is no previous case pending against the petitioner. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner. 1/3

Learned Government Advocate (Crl.Side) appearing for the respondent police, while opposing for grant of anticipatory bail to the petitioner, submitted that due to previous enmity, the petitioner along with the other accused, abused the defacto complainant in filthy language and assaulted him with knife and iron rod. He further submitted that the injuries sustained by the defacto complainant are grievous in nature. 5.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) for the respondent and perused the materials available on record.
6.Considering the gravity of offence committed by the accused and that the injuries sustained by the defacto complainant are grievous in nature, this Court is not inclined to grant anticipatory bail to the petitioner, at this stage. Accordingly, this Criminal Original Petition is dismissed. 22.11.2024 ata 2/3
