The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 115(2), 118(1), 351(3) of BNS, 2023, in Crime No.253 of 2024, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that due to previous enmity, the petitioner along with the other accused, abused the defacto complainant and the victim and assaulted the victim with a knife and thereby the victim sustained grievous injuries. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police, while opposing for grant of anticipatory bail to the petitioner, submitted that due to previous enmity, the petitioner along with 1/3

the other accused abused the victim in filthy language and assaulted him with hands and knife. He further submitted that there are five previous cases pending against the petitioner.

5.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) for the respondent and perused the materials available on record.

6.Considering the gravity of offence committed by the accused and that the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner, at this stage. Accordingly, this Criminal Original Petition is dismissed.
