PRAYER: Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the trial Court to expedite the trial within the stipulated period in S.T.C.No.171 of 2018 pending on the file of the learned Judicial Magistrate No.I, Pollachi.(amended as per order in Crl.Op.No.33481 of 2019 dated 18.12.2019) For Petitioner :

ORDER
The Criminal Original Petition has been filed to direct the learned Judicial Magistrate No.I, Pollachi to dispose of the case in S.T.C.No.171 of 2018 at early.
2.The learned counsel for the petitioner has submitted that the petitioner is facing trial for the alleged offence under Section 294(b), 323 and 506(i) of IPC. He further submitted that though the F.I.R was registered in the year 2016 and after investigation charge sheet was filed in the year 2017 and the case was taken on file as C.C.No.13 of 2017 by the learned Special Judicial Magistrate, Pollachi and subsequently, the said case was transferred to the learned Judicial Magistrate No.I, 1/2 https://hcservices.ecourts.gov.in/hcservices/
Pollachi and renumbered as S.T.C.No.171 of 2018, the trial not yet completed. Hence, he prayed to direct the trial Court to dispose of the aforesaid case at early.
3.The learned Government Advocate [Crl. Side] has submitted that totally nine witnesses cited by the prosecution and out of which, seven witnesses were examined and only two more witnesses to be examined and hence, he requested to fix some reasonable time for completing the trial.
4.Considering the aforesaid submissions, the learned Judicial Magistrate No.I, Pollachi is directed to complete the trial and dispose of the case in S.T.C.No.171 of 2018 within a period of three months from the date of receipt of a copy of this order.
5.Hence, this Criminal Original Petition is disposed of, with the above said direction.
