ORDER

The petitioner, who was arrested and remanded to judicial custody on 23.07.2025, for the offences punishable under Sections 318(2) and 64 of BNS Act in Crime No.205 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner made a promise that he will marry her and had sexual intercourse with her. Thereafter, failed to fulfil the promise. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner and the defacto complainant were studying in the same college and they fell in love and he had a consensual sex. The petitioner never promised the defacto complainant that he would marry her. Hence prays to grant bail.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the earlier bail application filed by the 2/4

petitioner in Crl.O.P.No.21873 of 2025 was dismissed on 01.09.2025 and this is the second bail application.

Considering the facts of the case and the earlier bail application filed by the petitioner was dismissed and there is no change in circumstances , this Court is not inclined to grant bail to the petitioner. 6.
