Heard.

2.This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure seeking withdrawal of HMOP No.97 of 2024 from the file of the Subordinate Court, Panruti, Cuddalore District and to transfer the same to the file of the Subordinate Court, Villupuram.

3. The marriage between the petitioner and respondent was solemnized on 11.12.2022 as per Hindu rites and customs at Sri Ranga Thirumana Mahal, PanrutiChennai road. The petitioner is the wife. It is stated that she is residing at Villupuram with the infant child and is unable to undertake travel to Panruti for each hearing, having regard to the distance and attendant hardship.

4. The said HMOP No.97 of 2024 has been filed by the respondent/husband seeking dissolution of marriage. It is also stated that the respondent is residing at Cuddalore.

5. Today, when the matter is taken up for hearing, there is no representation for the respondent/husband.

6. Considering the facts and circumstances, particularly, the petitioner being the wife having the care of an infant child, this Court is satisfied that the balance of convenience warrants transfer.

7. Accordingly, Tr.C.M.P. No.1032 of 2025 is allowed. H.M.O.P. No.97 of 2024 on the file of the Subordinate Court, Panruti, Cuddalore District is withdrawn and transferred to the file of the Subordinate Court, Villupuram. The Subordinate Court, Panruti, shall transmit the entire records to the Subordinate Court, Villupuram, within three (3) weeks from the date of receipt of this order and the Subordinate Court, Villuppuram shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order. There shall be no order as to costs. Consequently, connected miscellaneous petition in CMP No.23232 of 2025 is closed.
