The petitioner / A3 seeks bail in C.C.No.699 of 2023 now pending trial before the I Additional Special Court For Exclusive Trial of Cases Under NDPS Act, Chennai.

2.Original the petitioner / A3 was arrested and remanded to judicial custody on 09.07.2023 for the offences punishable under Sections 8(c) read with Sections 20(b)(ii)(C) of NDPS Act in Crime No.170 of 2023 on the file of the respondent. 3.It is the contention of the learned counsel for the petitioner that from A1 10 Kgs of Ganja and from A2 12 Kgs of Ganja had been seized. On the confession of A1 and A2, this petitioner had been arrested. It is stated that there was no recovery from the petitioner herein. 1/3

smv 4.The earlier petition seeking bail had been dismissed on 09.11.2023 in Crl.O.P.No.25689 of 2023 and it had been specifically stated that call details and evidences were available for contact between A1, A2 and this petitioner and also for transfer of money. The telephone numbers had also been given. It is seen that the telephone number of the petitioner is 9603811391 and the other accused telephone number is 8754119891 and there had been contact between the two for purchase and sale of Ganja.

5.In view of that particular fact, though investigation has been completed since the quantity of contraband is commercial in nature and this petitioner is seller of the Ganja to the other two accused, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
