O R D E R

The petitioner was arrested on 18.09.2024, on execution of NonBailable Warrant issued by the learned Additional District Judge, Hosur, Krishnagiri District, for the offence punishable under Sections 392, 302, 201 read with 34 IPC pending trial in S.C.No.116 of 2024 in respect of Crime No.50 of 2017 on the file of the respondent police, seeks bail.

2. The petitioner herein earlier arrested and granted bail. After the case was posted for committal to the Court of Sessions in S.C.No.116 of 2024, summons were issued to the petitioner on 27.06.2019, which was duly served on him by the respondent police. Since he was in prison, the Trial Court issued a P.T warrant against the petitioner on 13.09.2019, and he was produced before the Trial Court on 27.09.2019. Subsequently, though the petitioner was released on bail in other cases, he defaulted in appearance before the Trial Court. Hence, Non-Bailable Warrant (NBW) was issued. Thereafter, the petitioner was arrested and remanded to judicial custody on 18.09.2024.

3. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that that the case is now pending for trial, and petitioner was absconded for nearly 3 years.

4. Heard both sides and perused the materials available on record.

5. Considering the facts and circumstances of the case, and taking into account that the petitioner had remained abscond for nearly three years and that the trial is now likely to be fixed, this Court is not inclined to grant bail to the petitioner at this stage.
