ORDER
The petitioner, who was arrested and remanded to judicial custody on 04.07.2025 for the offences punishable under Sections 8(c) read with 22(b) and 29(1) of the NDPS Act, 1985 in Crime No.371 of 2025 registered on the file respondent police, seeks bail.

The case of the prosecution is that based on a secret information, the respondent police went to the spot and found that the accused/ A1 was in illegal possession of 1.0 gram of cocaine; that based on his confession, A2 was arrested on 18.06.2025, who was in possession of 10 grams of cocaine; that upon further investigation, A3 to A5 were arrested and from A5, 9 grams of methamphetamine,1.30 grams of brown methamphetamine, 2.75 grams of MDMA, 2.40 grams of OG ganja and 30 grams of ganja were seized; that upon confession of A5, it is revealed that the petitioner/ A7 was involved in the offence of illicit trafficking and sale of contraband. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner was falsely implicated in this case based on the confession of the co-accused and there is no seizure of contraband from the petitioner and he is in judicial custody since 04.07.2025. He further submitted that the coaccused was granted bail by the lower Court, vide order dated 20.08.2025 in Crl.M.P.No.5480 of 2025; and that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the prosecution case and stated that there are totally 7 accused in this case and the petitioner is arrayed as A7 and he has one previous case of similar nature. He further submitted that the petitioner along with other accused entered into a conspiracy for illicit trafficking, possession and sale of contraband for his personal gain; and that the lab report is yet to be obtained and the investigation is pending.

Considering the facts and circumstances of the case, the fact that huge quantity of different narcotic substances were involved in this case, the petitioner has one previous case of similar nature and taking note of the fact that the investigation of this case is pending, this Court is not inclined to grant bail to the petitioner.
