ORDER

The respondent/wife has filed this petition seeking to withdraw the case in H.M.O.P.No.313 of 2022, pending on the file of the Family Court, Coimbatore and to transfer the same to the Family Court, Namakkal.

2. The reasons for the transfer is that the petitioner is serving as an Assistant Manager in Tamil Nadu Grama Bank, Coimbatore and she has now been transferred to Namakkal. She has also shifted her residence to Namakkal and her minor daughter, K.Kansheka Sri, is studying at Spectrum Academy at Namakkal. The petitioner further submitted that her aged father, who is not in good health, is under her care and custody. If she is required to travel to Coimbatore, for every hearing, it would disturb the rhythm of her life, as she has no one, except her ailing father to take care of her daughter.

3. Taking note of the above reasons, this Court is of the opinion that the request of the petitioner is bona fide. Therefore, the Transfer Civil Miscellaneous Petition is allowed and the case in H.M.O.P.No.313 of 2022 pending on the file of the Family Court, Coimbatore, is withdrawn and transferred to the Family Court, Namakkal. Since the proceedings are at an advanced stage, a direction is issued to the learned Judge, Family Court, Namakkal, to dispose of the case in H.M.O.P.No.313 of 2022, on its transfer, within a period of three months, from the date of receipt of a copy of this order. Consequently, connected Miscellaneous Petition is also closed. No costs.
