R2 to R4 are the claimants and they were represented through a common counsel before the Tribunal and they had jointly filed a claim petition and therefore, respondents 2 to 4 will take care of the interest of R1. Hence, notice is dispensed with for R1. Notice to 5th respondent is dispensed with, since he remained exparte before the Tribunal. There is no representation either in person or through counsel for R2 to R4.

This Civil Miscellaneous petition has been filed seeking to condone the delay of 399 days in filing the Civil Miscellaneous Appeal.

Heard the learned counsel for the Appellant and perused the records.

Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 399 days is condoned.

Registry is directed to number the main Civil miscellaneous appeal, if it is otherwise in order and list the same for admission in due course.
