Writ Petition filed under Article 226 of Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records relating to the order of the third respondent issued in Na.Ka.No.6060/A4/2003, dated 12.09.2003, quash the same in so far as
the withholding of salary to the petitioner on the ground that she is a Junior Teacher in the CMS Evangelical Schools without deploying to needy school and direct the respondents to pay salary to the petitioner from September 2003 with other benefits and to deploy the petitioner to any one of the vacant secondary grade Teacher post. When this matter is taken up for hearing, the learned Additional Government Pleader appearing for the respondents has produced a copy of the order dated 17.12.2008 passed by the District Elementary Educational Officer, Tirunelveli, Tirunelveli District before this Court, in which it is stated that the District Elementary Educational Officer, Tirunelveli, Tirunelveli District, as per G.O.No.1228, School Education Department, dated 30.12.1994 sanctioned the payment of Rs.14,50,583/- (Fourteen Lakhs Fifty Thousand Five Hundred and Eighty Three only) being the arrears teaching grant for the year 2003-2007 to the management of the school in the TPF Account of the teacher concerned and the annexure of the payment details is enclosed herewith and hence, the petition may be closed.
2. Recording the submission made by the learned Additional Government Pleader appearing for the respondent, this writ petition is closed. No costs. Consequently, connected Miscellaneous Petition is closed.
