JUDGMENT

(Judgment of this Court was delivered by M.S.RAMESH.J) This Writ Appeal has been filed to set aside the order made in W.P.No.7324 of 2018 dated 30.08.2023.

2. The main ground on which the present appeal has been filed is that the workmen had entered into an agreement dated 28.10.2020 under Section 18(1) of the Industrial Disputes Act, 1947, wherein in Clause 2.7, the workman had agreed that he would not press the Writ Petition in W.P.No.7324 of 2018. However, both the parties before the Writ Court had failed to bring this agreement to the notice of the Court. Thus, final orders came to be passed in the Writ Petition on 30.08.2023, without reference to the said agreement.

3. It is now submitted by the learned Senior Counsel for the Management that they had inadvertently failed to bring the agreement entered into between the parties, dated 28.10.2020, to the notice of the Writ Court.

4. The learned counsel appearing for the workmen also accepted and submitted that he has no objection to the present Writ Appeal being

allowed, in view of the agreement under Section 18(1) entered between them.

5. In consideration of the submissions made and without going into the merits of the observations made, the order passed by the learned Single Judge in W.P.No.7324 of 2018 dated 30.08.2023 is set aside. Accordingly, the Writ Appeal stands allowed. No costs. Consequently, connected miscellaneous petition is closed.
