ORDER

The petitioner, who was arrested and remanded to judicial custody on 11.06.2025, for the offences punishable under Sections 8(c) and 22(C) of the Narcotic Drugs and Psychotropic Substance Act, 1985 in Crime No.401 of 2025, registered on the file of the respondent police, seeks bail. 2.

The case of the prosecution is that based on a secret information, the respondent police went to the spot and found that the petitioner was in illegal possession of 55 grams of Methamphetamine for the purpose of sales. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner was falsely implicated in this case and stated there are CCTV footages to show that the petitioner was taken to the police station by the respondent police prior to registration of FIR, in order to foist a false case against the petitioner. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the petitioner has one previous case of similar nature and the contraband seized from the petitioner is of commercial quantity; and that the investigation is pending. 5.

Considering the facts, gravity of offence, the contraband seized from the petitioner is of commercial quantity, the previous antecedents of the petitioner, the conditions under Section 37 of NDPS has not been satisfied and the investigation is pending, this Court is not inclined to grant bail to the petitioner.

Accordingly, this criminal original petition stands dismissed. 22.09.2025 stn 3/4
