ORDER
This Sub Application is filed to revive the Contempt Petition vide Contempt Petition No.605 of 2018 which was closed by this Court on 06.02.2019
2. The learned counsel for the petitioner contended that this Court, by order dated 22.03.2017 in W.P.No.18229 of 2008 directed the respondents to approve her appointment as Secondary Grade Teacher with effect from 15.04.1998 with all consequential service benefits. Aggrieved by the said order, the respondent has preferred Writ Appeal in W.A.No.956 of 2018. The Hon'ble Division Bench by Judgment dated 04.07.2018, dismissed the Writ Appeal and confirmed the order passed in W.P.No.18229 of 2008.
3. Learned counsel further submits that the respondents preferred Special Leave Petition (Civil) Diary No.1327 of 2019 before the Hon'ble Supreme Court and the Hon'ble Apex Court by order dated 25.01.2019, while disposing the SLP by condoning the delay, observed that no ground was made out to interfere with the impugned Judgment of the High Court. The Apex Court however, granted liberty to the respondents to approach the High Court by filing a review application on the grounds raised in the Memorandum of Appeal and were also granted liberty to approach the Hon'ble Supreme Court again in the event of adverse order is passed in the Review Application.
4. It is brought to the notice of this Court that pursuant to the liberty granted by the Hon'ble Supreme Court, the respondents have filed the review application before the Hon'ble Division Bench of this Court and that the same is pending consideration.
5. In view of the pendency of the Review Application and the liberty granted by the Hon'ble Supreme Court, this Court is of the view that no useful purpose would be served by reviving the Contempt Petition at that stage, as the rights of the parties would depend upon the outcome of the Review Application and any further proceedings, that may be initiated.
6. Accordingly, this Sub Application is closed. 29-06-2026 Index : Yes/No Internet : Yes/No KKD
