O R D E R

This Petition has been filed to direct the 4th respondent to implement the order passed by the 3rd respondent dated 29.07.2025 in Oo.Mu.No.2028/2025 A1 based on the representation dated 05.04.2025 sent by the petitioner within a stipulated time.

2. Heard the learned counsel appearing for the petitioner, learned Government Advocate (Crl.Side) appearing for the respondents 1 to 6 and the learned counsel for the respondents 7 and 8.

3. On perusing the entire documents placed on record, it is seen that the petitioner is the maternal uncle of the respondents 7 and 8 and the petitioner owned the agricultural property situated in S.F.No.334 to an extent of 6.92 acres, Vettaikarapudur Village, Ananaimalai Taluk. Since the petitioner had no issues, the 7th respondent is living along with the petitioner. However, the 7th respondent dispossessed the petitioner from petitioner's land and failed to maintain the petitioner, therefore, the petitioner approached the 3rd respondent under Section 23 of the Maintenance of Welfare of Parents and Senior Citizens Act, 2007. After due enquiry, the 3rd respondent, passed an order by restraining the respondents 7 and 8 herein from interfering with the peaceful possession and enjoyment of the petitioner in respect of the subject land and further observed that if any violation occurs, the concerned jurisdictional police was directed to take appropriate action as against them.

4. It is to be noted that now, once again, the petitioner was restrained by the respondents 7 and 8 from his peaceful possession and enjoyment of the subject land. Though the petitioner lodged a complaint, no action has been taken as against the respondents 7 and 8 herein.

5. It is the submission of the learned counsel appearing for the respondents 7 and 8 that already in this regard, suit is pending. The 7th

respondent filed a suit as against the petitioner for declaration and it is pending in O.S.No.563 of 2025 on the file of learned IV Additional District Court, Coimbatore. He further submitted that the 8th respondent also purchased some part of the property and also filed O.S.No.577 of 2025 for declaration and injunction on the file of the IV Additional District Court, Coimbatore and it is also pending.

It is to be noted that mere pendency of the suits would not preclude the 4th respondent from taking action as against the respondents 7 and 8, therefore, the 4th respondent is directed to comply with the order passed by the 3rd respondent dated 29.07.2025 in Oo.Mu.No.2028/2025 dated 05.04.2025 and if any complaint has been lodged by the petitioner, the respondents 4 and 5 are directed to take appropriate action as against the respondents 7 and 8 herein in accordance with law.

With the above observation, the present Petition is disposed of. No costs.
