The petitioner seeks anticipatory bail in Crime No.234 of 2023 registered by the respondent Police for the offences originally under Sections 294(b), 323, 506(i) of IPC and later altered to Sections 294(b), 323 and 306 of IPC.

It is the case of the prosecution that the de-facto complainant was returning from home, when the petitioner and his father approached her and said that her husband had stolen their bicycle and asked for its return. She also assured its return. Thereafter, the petitioner appears to have gone over to the house of the de-facto complainant to get the bicycle and the de-facto complainant stated that she would return it after her husband comes back. The next day, the petitioner and other family members had scolded the de-facto complainant in public, consequent to which she had taken poison and subsequently died. Hence, this case.

3. Though the learned counsel for the petitioner put up probable reasons for the attitude of the de-facto complainant, let me not state those reasons since it would only prejudice the case of the petitioner herein to his disadvantage.

4. At this stage, since investigation is still pending, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
