ORDER

Mr.C. Selvaraj, learned Additional Government Pleader, takes notice for st respondent; Mr.Yogesh Kannadasan, learned Special Government the 1 nd respondent and Ms.Indhu Bala, learned Additional Pleader takes notice for 2 rd respondent. By consent of both the Government Pleader, takes notice for the 3 parties, this writ petition is taken up for final disposal at the admission stage itself.

The relief sought in this writ petition is a direction to the respondents to dispose of the petitioner's representation dated 12.08.2024 and appoint her in any suitable last grade post as per the directions issued by this Court, earlier on 18.03.2024 in Cont. Rev. P. No.1121 of 2023 and Rev. Appln.(W) No.43 of 2024.

3. Short facts leading to the filing of this writ petition are as follows :- a) The petitioner was appointed as a Temporary Gardener in the Special Grade Yercaud Panchayat in the year 1995. During the year 1997, her name was erroneously entered as Typist in the muster roll and hence, her services were ousted on the ground that there was no sanctioned post available in the said category.

However, similarly placed persons, who were appointed along with her, were allowed to continue in service.

b) After several legal battles, she was appointed as Mazdoor (NMR), and thereafter, she submitted a representation requesting that she may be considered for any suitable post, since the post of Dengue Mazdoor does not fall under the last grade category and she may be posted within the place of Yercaud Panchyat Union. Ventilating all her grievances, she submitted a representation to the 2 nd respondent on 12.08.2024. As the said representation was not considered by the respondents, till date, the petitioner has filed this writ petition with the aforesaid prayer.

4. Learned counsel for the petitioner would submit that the petitioner was ousted from service due to a clerical mistake in the muster roll, for which, she cannot be put to hardship. He would further submit that similarly placed persons, who were appointed along with the petitioner, were allowed to continue and have been regularised, whereas, the petitioner alone has been denied employment. Therefore, he submitted that some consideration may be shown on the petitioner on a par with similarly placed persons and therefore, it would suffice, if a direction is issued to the respondents to consider the petitioner's representation dated 12.08.2024, based on the earlier orders passed by this Court in the above regard, within a time frame.

Learned Special Government Pleader appearing for the 2 nd respondent submitted that the petitioner was appointed for a specific work on temporary basis and therefore, she cannot claim regularisation as a matter of right comparing herself with others, who were appointed on regular basis. However, 4/7

he fairly submitted that the petitioner's representation dated 12.08.2024 will be considered by the 2 nd respondent on merits and in accordance with law.

6. Concurring with the aforesaid submission, learned Additional Government Pleader appearing for respondents 1 and 3 would submit that this Court may issue appropriate directions in this regard.

Considering the fair submissions made by the learned Special nd respondent, without going into the Government Pleader appearing for the 2 nd respondent to consider the merits of the case, this Court directs the 2 petitioner's representation dated 12.08.2024, with regard to her claim for appointment, and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

8. The writ petition is disposed of with the above directions. No costs. 09.10.2025 5/7
