ORDER

The petitioner, who is an accused in S.C.No.81 of 2024 on the file of the Additional District Judge, Hosur was arrested and remanded to judicial custody on 11.07.2024 for the offence punishable under Sections 147,148,341,427,452,302 of I.P.C r/w 109,120(B) of I.P.C in Crime No.779 of 2025, registered on the file of the respondent police seeks bail. 2.

The case of the prosecution is that due to previous enmity, the petitioner attacked the defacto complainant with knife and caused grievous injuries to him. Hence, this case.

3. The learned counsel appearing for the petitioner submitted that co-accused in this case were released on bail. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case. He further submitted that one of the co-accused is still absconding and the other persons who were already granted bail had 2/4

threatened the witnesses, therefore the bail was cancelled. He also submitted that the trial could not be commenced in this case due to noncooperation of the petitioner. 5.Considering the facts that the trial has not yet commenced and witnesses was also threatened. bail cannot be granted at this stage, therefore this Court is not inclined to grant bail to the petitioner.
