ORDER

Mr.K.Surendran, learned Additional Government Pleader accepts notice on behalf of the Respondents 1, 3 & 4. With consent of the learned counsel on either side, this writ petition is taken up for final disposal.

2. This Writ Petition has been filed to direct the respondents to consider the petitioner's representation dated 28.07.2025 and to take departmental action against the Taluk Surveyor Mr.T.Prasanna Kumar 2/6

Magantha, VAO Mr.K.Rajivgandhi and Tahsildar Mr.A.R.Shanbasha.

3. The case of the petitioner is that the petitioner had preferred a complaint against the Taluk Surveyor, alleging that he had issued a forged Natham Chitta in respect of the petitioner's land. Based on his complaint, the third respondent conducted an inspection and submitted a report. Based on the said report, the Tahsildar, Keelpennathur passed an order transferring the said Taluk Surveyor. However, several fradulant Natham Chitta and pattas issued by the said Surveyor continue to remain in force and they have wrongfully subdivided the land and altered the revenue records and village map. Thereafter, the petitioner submitted a detailed representation dated 28.10.2024 to the first respondent. Based on which, the Revenue Inspector and the Village Administrative Officer, Vettavalam admitted that Natham Survey Nos.

215/90 and 215/91 had been subdivided on 17.08.2020 without the knowledge of the landholder. However, without taking into consideration the statements given by the said officers, the Tahsildar, Keelpennathur passed an order dated 24.06.2025. Aggrieved by the same, the petitioner preferred an appeal before the first respondent on 21.08.2025 and the same was also pending as on date. In the meantime, the petitioner also submitted a further representation dated 28.07.2025, which has not been considered till date.

Hence, the petitioner filed this writ petition.

4. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents 1, 3 & 4.

Taking into consideration, without going into the merits of the case, a direction is issued to the first respondent to consider the representation of the petitioner dated 28.07.2025 and pass orders, on its own merits, in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. It is made clear that this Court has not made any observation with regard to the merits of the petitioner's claim.

6. With the above direction, this Writ Petition is disposed of. No costs.
