ORDER

The petitioner, who apprehends arrest at the hands of the respondent

police for the offence punishable under Section 4(1)(A) of TNP Amendment Act, 2024, in Crime No.334 of 2025, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 09.08.2025, at about 9.30 a.m., when the respondent police was conducting a raid at Velankanni Main Road, Madhakulam, at that time, the petitioner along with other accused were found selling liquor at an inflated price. When they conducted a search, they found that the petitioner along with other accused were found in possession of 290 litres of liquor worth Rs.4,40,000/-. Based on which, the respondent police arrested the accused and seized the liquor. Hence, the complaint.

3. The learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that the petitioner name was found in the FIR. Only based on the confession of the arrested accused, this petitioner was arrested. Hence, he prays for grant of anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case and on instructions submitted that the petitioner is a bar owner and that there are totally four accused in this case and the petitioner herein is ranked as A1. The petitioner has two previous cases pending against him.

5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) for the respondent and also perused the materials available on record.

6.Considering the nature of the dispute, since the petitioner is a bar owner and has two previous cases against him, and considering the fact that the petitioner was an illegal possession of liquor, this Court is not inclined to grant anticipatory bail to the petitioner.
