O R D E R

The petitioners herein apprehend arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(c) and 4(1)(A) of the 1/6

Tamil Nadu Prohibition (Amendment) Act, 2024 in Crime No.250 of 2025, on the file of the respondent Police, seek anticipatory bail.

2. The petitioners apprehend arrest for the alleged illegal possession of 7 bottles of MGM Diamond xxx Rum each containing 180 ml and 3 bottles of Express Special Brandy each containing 180 ml and 10 bottles of Bangalore Rum each containing 90 ml.

3. The learned counsel appearing for the petitioners state that the petitioners are innocent persons and they have not committed any such offence as alleged by the prosecution. Hence, he prayed for grant of anticipatory bail to the petitioners.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that these petitioners are habitual offenders. So far as A1 is concerned, there are 5 previous cases are pending and A2 is concerned, there are 37 previous cases are pending. Hence, he opposed for grant of anticipatory bail to the petitioners 2/6

5.Considering the said fact and being an habitual offenders, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition stands dismissed.
