ORDER

The petitioner, who apprehends arrest by the respondent police for the offences punishable under Sections 303(2) and 326(a) of BNS Act 2023, in Crime No.229 of 2025, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner along with other accused was found illegally transported 3 1⁄2 units of river sand in a lorry. The respondent police seized the contraband and registered a case against the petitioners. Hence, the complaint.

3.The learned counsel appearing for the petitioner submits that he is no way connected with the alleged occurrence. The petitioner is the owner of the lorry and he has not involved his vehicle in any illegal activities and he has been falsely implicated in this case. Hence, the learned counsel prays for grant of anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl.side) appearing for the

respondent police submits that the arrested accused/A1 is still in judicial custody. He further submitted that the petitioner has one previous case pending against him. Hence, he strongly opposes the grant of anticipatory bail to the petitioner.

5.Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl.side) and perused the materials available on record. 6.Considering the rival submissions made on both sides, and also considering the fact that the arrested accused is still in judicial custody and the petitioner has one previous case pending against him, this Court is not inclined to grant anticipatory bail to the petitioner.

5. Accordingly, this Criminal Original Petition is dismissed. 17-09-2025 Gbi
