Mathew v. The Sub Inspector Of Police

2023-12-14Honourable Mr Justice C.V. Karthikeyan2 pages

Crl.O.P.No.27952 of 2023 C.V.KARTHIKEYAN,J.

The petitioners/A2 and A4, who are brother and mother of A1, seek bail in Crime No.217 of 2023, originally registered as 'girl missing' and subsequently, altered to Sections 363, 366, 366(A) of IPC. The petitioner had been remanded to custody on 09.11.2023.

2.It is stated that A1 is said to have kidnapped the daughter of the defacto complainant and in that regard H.C.P.No.1655 of 2023 is pending before this Court. In the meanwhile, this particular bail application has been filed as a ruse to scuttle further investigation into the said issue. 3.Investigation is still not completed. The girl has still not been found. A1 is absconding. The petitioners lack bonafide. I am not inclined to grant bail to the petitioners. Accordingly, this Criminal Original Petition stands dismissed. 14.12.2023 ata 1/2 https://www.mhc.tn.gov.in/judis
