This petition has been filed seeking to set aside the order dated 22.11.2019 made in C.M.A.No.12 of 2009 which was dismissed for non prosecution on 22.11.2019 and restore the civil miscellaneous appeal on the file of this Court.

2.The petitioner/ appellant had filed C.M.P.No.28631 of 2023 seeking to condone the delay of 1319 days in filing the restoration petition and this Court vide order dated 12.04.2024 allowed the said petition on condition that the petitioner takes a fixed deposit receipt in any nationalized bank for a sum of Rs.2 Lakhs favouring the Registrar General of this Court to the credit of the appeal viz., C.M.A.No.12 of 2009 on or before 22.04.2024. On 23.04.2024, this Court has recorded that the order dated 12.04.2024 has been complied with and has directed the Registry to number the petition seeking to restore the appeal. Accordingly, this petition has been listed before this Court today.
