The petitioner/A2, who apprehends arrest for the alleged offence under Sections 8(c), 20(b)(ii)(A) and 29(1) of Narcotics Drugs and Psychotropic Substance Act, 1985 and Section 132 of BNS, 2023 in Crime No.527 of 2024 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that when the respondent and his team were on their regular patrol duty, on 13.09.2024 near Aarumbakkam Burial Ground, they found that the accused were indulged in selling Ganja and from them, 80 grams of Ganja were seized. Hence the case.

3. Learned counsel for the Petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prays

for grant of anticipatory bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police, while opposing for the grant of anticipatory bail for the petitioner, would submit that the petitioner along with other accused had indulged in selling Ganja and from them, 80 grams of Ganja were seized. He would further submit that seven previous cases are pending against the petitioner, out of which, one case is registered for the offence under the Narcotics Drugs and Psychotropic Substance Act.

5. Heard the learned counsel appearing for the petitioner, the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record.

6. Taking into consideration the facts and the submissions made by the learned Government Advocate (Criminal Side) and also considering the previous cases pending against the petitioner, this Court is not inclined to grant bail to the petitioner.
