PRAYER : Writ Petition has been filed under Article 226 of the Constitution of India, to issue Writ of Mandamus directing the 1st respondent police herein to give police protection by considering the representation / complaint dated 22.10.2023 given by the petitioners herein.

ORDER

The petitioners claiming to be the owner of the property situated in T.S.No.17/2, Block 17, Ward H, Alandur measuring 0.644.2 cm, alleging life threat at the hands of the 2nd and 3rd respondents has given a representation to the respondent police on 22.10.2023 seeking police protection. Since no visible protection given to them, the present Writ Petition is filed. 2.

The learned counsel appearing for the petitioner drew the attention of this Court, how the dispute regarding title between the petitioners and the respondents 2 and 3 had come to an end by proceedings of Assistant Land Commissioner dated 23.03.2020 confirming the title of the petitioners herein subject to outcome of W.P.No.21014 of 2019 initiated by the private respondents. However, later the private respondents had withdrawn the Writ Petition on 25.11.2022. Thus, there is nothing more to agitate about the title. 3.

In such circumstances, it is alleged that the private respondents are causing disturbance frequently through rowdy elements to dispossess the petitioners herein. Since there is prima facie material to direct the 1st respondent to give police protection to the petitioners, the learned Government Advocate Page No.2/4

(Crl.Side) is directed to take notice and instruct the 1st respondent to consider the representation of the petitioners herein dated 23.10.2023 in accordance with law.
