ORDER

Mr.S. Prabhakaran, learned Government Advocate takes notice for respondents 1 to 3 and Mr.T. Ravikumar, learned Standing Counsel takes notice for the 4th respondent. By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.

2. The petitioner was initially appointed as a Part-time Vocational Instructor in the year 1986 and was subsequently absorbed as a Full-Time Computer Instructor on 05.10.1996. On attaining the age of superannuation, he retired from service on 31.03.2025, with a brief extension granted up to 31.05.2025.

3. It is the case of the petitioner that he was granted Selection Grade on 05.10.2006 as per G.O. Ms. No.306 Finance (CMPC) Department, dated 12.08.2018, and his Grade Pay was accordingly fixed at Rs.5,400/-. However, while sanctioning pension, the 4th respondent erroneously fixed the Grade Pay 2/6

at Rs.4,800/-. Subsequently, the 2nd respondent withheld the petitioner's pension and retirement benefits, citing non-issuance of the "No Due Certificate."

4. The petitioner had applied for the said certificate in June 2025, but till date, the respondents have failed to issue the same as a result of which, his retirement benefits have been withheld. In this regard, the petitioner had sent representations to the 3rd respondent on 11.06.2025 and to the 2nd respondent on 01.08.2025, requesting them to issue the "No Due Certificate".

5. It is the grievance of the petitioner that despite repeated representations, neither any reply has been received nor the requisite Certificate issued to him. Hence, this writ petition has been filed with the aforesaid prayer.

6. Heard the learned counsel for the petitioner and perused the records.

7. Learned Government Advocate appearing for the respondents 1 to 3 would fairly submit that the petitioner's representation, dated 01.08.2025(latest one) would be considered by the 2nd respondent, if not already considered, within a stipulated time frame, as may be directed by this Court.

8. In view of the fair submission made by the learned Government Advocate, this Court, without going into the merits of the case, directs the 2nd respondent to consider the petitioner's representation dated 01.08.2025 with 3/6

regard to the issuance of No Due Certificate, and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. No costs.

9. With the aforesaid directions, this writ petition stands disposed of. No costs.
