Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1st Respondent to refer Petitioner's land acquisition case in respect of the property situated in Survey No.710/3B, (measuring to the extent of 4800 Sq.Ft. vide Plot Nos.96 and 97) purchased vide a sale deed dated 11.03.1982 in Doc.No.946/1982 registered at the office of the Sub-Registrar, Saidapet, Chennai referred to in Award No.2/2009 dated 21.11.2009 passed by him, to the concerned jurisdictional Civil Court in term of Section 20(1) of Tamil Nadu Highways Act, 2001 on the basis of Petitioner's application dated 10.12.2009 as expeditiously as possible preferable within the time stipulation as prescribed by this Court.

ORDER

This writ petition has been filed to issue a Writ of Mandamus, directing the 1st Respondent to refer Petitioner's land acquisition case in respect of the property situated in Survey https://hcservices.ecourts.gov.in/hcservices/

No.710/3B, (measuring to the extent of 4800 Sq.Ft. vide Plot Nos.96 and 97) purchased vide a sale deed dated 11.03.1982 in Doc.No.946/1982 registered at the office of the Sub-Registrar, Saidapet, Chennai referred to in Award No.2/2009 dated 21.11.2009 passed by him, to the concerned jurisdictional Civil Court in term of Section 20(1) of Tamil Nadu Highways Act, 2001 on the basis of Petitioner's application dated 10.12.2009 as expeditiously as possible preferable within the time stipulation as prescribed by this Court.

2. In view of the order passed in W.P.No.15670 of 2018 dated 27.06.2018 and considering the limited relief sought for in the petition, without expressing any opinion on merits of the writ petition, the 1st respondent is directed to consider the representation of the petitioner dated 10.12.2009, after issuance of notice to the petitioner and counter parties, if any and after giving opportunity of hearing to them, pass orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

3. With the above direction, this writ petition is disposed of. No costs.
