ORDER
This petition has been filed seeking a writ in the nature of mandamus directing the 3rd respondent to consider and pass suitable orders on the representation of the petitioner dated 12.10.2023 and effect change of petitioner's name with respect to the dry lands in Survey No.98/1 to an extent of Hectare 0.65.0 ares (Acre 1.60 cents) comprised in Patta No.120, situate at Melmurungai Village, Pernambut Taluk, Vellore District, now standing in the name of Harijan Colony Natham Poramboke.
2. According to the petitioner, the land measuring an extent of 0.65.0 Hectares referred to above originally belonged to her husband-A.G.Jothi Mudaliar and he died intestate on 03.11.2000. On his death, she got the same in the family arrangement. She has been enjoying the same by raising crops. Though the land acquisition proceedings were initiated in respect of the land for harijan welfare scheme, on a challenge to the acquisition proceedings by her husband by filing W.P.No.2055 of 1996, this court was pleased to quash the
land acquisition proceedings by order dated 05.07.1996. Though liberty was given to the authorities to proceed under Tamil Nadu Act 31 of 1978, no steps were taken by the authorities during the life time of her husband or even after his death. The grievance of the petitioner is that despite representation for mutation of revenue records in her name, no action was taken on the same.
3. Heard both sides.
4. The learned Additional Government Pleader would, on instructions, while admitting the fact that the land acquisition proceedings had already been quashed by this court and no fresh acquisition proceedings were initiated, submit that steps would be taken to effect mutation of revenue records in the name of the petitioner.
5. In the light of the above, the 3rd respondent is directed to consider the application of the petitioner dated 12.10.2023 for mutation of revenue records in her name and pass appropriate orders thereof on merits and in accordance with law within a period of one month from the date of receipt of a copy of this order. This writ petition is disposed of with the above directions. No costs. Index : yes / no 25..06..2024 : yes / no kmk
