The award of the Labour Court, setting aside the order of dismissal and ordering for reinstatement with back wages was challenged in the Writ Petition in W.P.No.4820 of 2016, which was also dismissed on 17.07.2023.
2.In the present Appeal, the order in the Writ Petition is put under challenge. Pending the Writ Appeal, the Management had deposited a sum of Rs.50,000/- towards the backwages for each of the private
respondents / workmen herein. Mr.Ravi, the learned Senior Counsel appearing for the Management, offered to pay a sum of Rs.2,50,000/- (including Rs.50,000/-) to each workman, as a full and final settlement, in lieu of the relief granted in I.D.Nos.102 to 108 of 2012, on the file of II Additional Labour Court, Chennai.
3.Mr.B.Gandhi, the learned counsel appearing for the respondents 2 to 8 accepted the offer of Rs.2,50,000/- as a full and final settlement in lieu of the relief granted in I.D.Nos.102 to 108 of 2012, on the file of II Additional Labour Court, Chennai.
4.In view of the amicable settlement arrived at between the parties, no further orders are required.
5.At this juncture, it is brought to the notice of this Court that the 4th respondent herein viz. Tmt.A.Chandra, had expired on 12.09.2023, and the learned counsel for the Management / appellant is unable to contact the legal heirs of the deceased workman.
6.The Management is called upon to deposit a sum of Rs.2,00,000/-, apart from Rs.50,000/- already in deposit, to the credit of I.D.No.104 of 2012, as full and final settlement amount due to the legal heirs of Late Tmt.A.Chandra. within a period of four (4) weeks from the date of receipt of a copy of this order. Consequently, the legal heirs of Late Tmt.A.Chandra, are at liberty to file an appropriate application before the concerned Labour Court for withdrawal of the said sum of Rs.2,00,000/- along with the sum of Rs.50,000/- lying in deposit in the name of the deceased workman, on the file of I.D.No.104 of 2012, after satisfying the Labour Court about the status of their legal heirship. 7.The other respondents / workmen herein are also at liberty to file an application before the Labour Court to withdraw the deposit lying on the file of I.D.Nos.102, 103, 105, 106, 107 and 108 of 2012, together with accrued interest.
8.Whenever such an application is made, the Labour Court shall endeavour to dispose of the same as expeditiously as possible, in any
event, within a period of one (1) week from the date of receipt of the application.
9.The Writ Appeal stands disposed of accordingly. No costs. Consequently, the connected miscellaneous petition is closed. [M.S.R, J.] [R.S.V, J.] 17.11.2025 kas Index: Yes / No Speaking / Non Speaking To.
