Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for issuance of Writ of Mandamus, directing the 2nd respondent to conduct the survey of the property situate at Kadagathur Village, Dharmapuri Taluk and District in S.No.578/1, measuring 2.58 Acres and fix the boundaries with the assistance of the 5th respondent by considering the representation made by the petitioner dated 13.03.2025.

ORDER

This Writ Petition has been filed seeking a direction the second respondent to conduct the survey and fix the boundaries of the petitioner's property comprised in S.No.578/1, measuring an extent of 2.58 acres, situated at Kadagathur Village, Dharmapuri Taluk, by considering the representation made by the petitioner dated 13.03.2025.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

The petitioner had purchased a land comprised in S.No.578/1, measuring an extent of 2.58 acres, situated at Kadagathur Village, Dharmapuri Taluk, from one Nanjammal, through a registered sale deed vide document No.760 of 2025. In order to survey the said land, the petitioner submitted an application before the second respondent and also paid requisite fees for the same. So far the second respondent did not take any steps to survey and demarcate the land

belongs to the petitioner. Hence, this writ petition.

In view of the above, the second respondent is directed to survey the petitioner's aforesaid land based on the title deed produced by the petitioner, after issuance of notice to the adjacent land owners and counter parties, if any, and to serve the survey report to the petitioner within a period of six weeks from the date of receipt of copy of this order. It is made clear that, if the surveyor concerned is obstructed by third parties while surveying the subject land, the said surveyor can approach the jurisdictional police seeking police aid and on such request, the jurisdictional police shall provide adequate police protection to the surveyor.

5. With the above direction, this writ petition is disposed of. There shall be no order as to costs.
