O R D E R

This revision is filed seeking a direction to dispose of E.A.No.4 of 2019 in E.P.No.11 of 2009 in O.S.No.540 of 2006, pending on the file of the learned First Additional District Judge, Coimbatore, within a time frame.

2. Considering the nature of order to be passed in this revision which will in no way cause any prejudice to the respondents, notice to the respondents is dispensed with.

3. The suit is for specific performance. The first respondent is the plaintiff/decree holder. The suit has been decreed against the second respondent herein. The first respondent has filed an execution petition in E.P.No.11 of 2009 for execution of the decree. Pending E.P., the petitioner herein claiming to be the purchaser of the property filed an application in E.A.No.4 of 2019 under Order XXI Rule 97 of C.P.C. Learned counsel appearing for the petitioner submitted that the said application has not been disposed of by the learned First Additional District Judge, Coimbatore and therefore he filed the present revision seeking early disposal of the said application within a time frame.

4. Considering the limited scope of the prayer made in the revision, the learned First Additional District Judge, https://hcservices.ecourts.gov.in/hcservices/

Coimbatore, is directed to dispose of the application in E.A.No.4 of 2019 in E.P.No.11 of 2009 in O.S.No.540 of 2006 on or before 28.02.2020, on merits and in accordance with law, after giving opportunity to both the parties.
