Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India

praying for issuance of Writ of Mandamus, directing the second respondent to consider the representation of the petitioner dated 18.08.2025 and consequentially directing the second respondent to conduct an enquiry to cancel the fraudulent free patta issued under award No.3/92-93 dated 31.12.1992 vide plot No.90 measuring 2.5 cents, comprised in Survey No.428/1B2X2 of Melmudalambedu Village, Gummidipoondi Taluk, Tiruvallur District, issued in the name of the sixth respondent and to remove the encroachment.

ORDER

This Writ Petition has been filed seeking a direction to the second respondent to consider the petitioner's representation dated 18.08.2025 seeking to conduct an enquiry for cancellation of the fraudulent free patta issued under Award No.3/92-93 dated 31.12.1992, in respect of Plot No.90, measuring 2.5 cents, comprised in Survey No.428/1B2X2 situated at Melmudalambedu Village, Gummidipoondi Taluk, Tiruvallur District, standing in the name of the sixth respondent and for removal of the encroachment.

2. Heard the learned counsel appearing for the petitioner, the learned Government Advocate appearing for the respondents 1 to 5

and perused the materials available on record.

3. It is seen from the records that, on receipt of the representation, the second respondent called for a report from the fourth respondent. Pursuant to the same, the fourth respondent is conducting an enquiry.

4 In view of the above, the fourth respondent is directed to submit a report to the second respondent within a period of four (4) weeks from the date of receipt of a copy of this order. On receipt of such report, the second respondent is directed to issue notice to the parties concerned, afford them an opportunity hearing and pass appropriate orders on merits and in accordance with law, within a period of twelve

(12) weeks thereafter.

5. With the above direction, this Writ Petition stands disposed of. No costs.
