ORDER
This Writ Petition is filed for issuance of a writ of mandamus, directing the respondent to settle the retirement benefits with 6% interest for the belated settlement of retirement benefits to the petitioner, by considering his representations, dated 01.08.2025 and 09.09.2025.
2. The case of the petitioner is that he joined as Clerk in the respondent Corporation on 01.12.1988 and retired from service on 31.12.2023, on attaining the age of superannuation. Even after passing of 20 months from the date of retirement, his terminal benefits have not been settled. Hence, he is eligible for interest at 6% per annum for the belated settlement of retirement benefits. In this regard, he submitted a representation to the respondent on 09.09.2025, requesting to settle retirement benefits along with interest at 6% per annum for the belated payment. However, no action has been taken by the respondent. Hence, he has come before this Court by way of this Writ Petition.
3. Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondent.
4. Taking into consideration the facts and circumstances of the case and the materials available on record, this Writ Petition is disposed of with a direction to the respondent Corporation to pay the permissible amount
with interest at the rate of 6% per annum for the belated period of payment of terminal benefits to the petitioner within a period of six weeks from the date of receipt of copy of this order. It is made clear that if the amount is not paid within the time frame fixed by this Court, it will fetch interest at the rate of 9% per annum from the date on which the amount became due and payable till the date of realisation. No costs.
