ORDER

This application is filed to grant leave to the Applicant/Plaintiff to institute the suit to sell the plaintiff-trust properties.

2. According to the applicants, the schedule mentioned property is very old building and it is in dilapidated condition and already the tenants have also vacated the premises and there is no income to fulfil the object of the trust. Further, the application mentioned property also does not fetch any income, hence the applicants intend to sell the property for the benefit of the trust.

3. Considering the reasons stated in the affidavit, cause of action arose within the jurisdiction of this Court and the facts and circumstances of the case, the present application is allowed. Leave is granted. The Registry is directed to number the suit if it is otherwise in order.
