ORDER

The petitioner, who was arrested and remanded to judicial custody on 08.08.2025, for the offences punishable under Sections 305(a) of BNS in Crime No.43 of 2025, registered by the respondent police, seeks bail. 2.

The case of the prosecution is that the petitioner along with other accused entered into Rajiv Gandhi Government General Hospital and stolen mobile phone from the defacto complainant, who is a Resident Doctor at Rajiv Gandhi Government General Hospital. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the petitioner is hailing from Assam and based on the CCTV footages in the hospital, the petitioner is arrayed as 2/4

accused in this case. He further submitted that the petitioner has one previous case and the stolen mobile phone is not recovered yet; and that the investigation is pending.

Heard the learned counsels and perused the materials available on record.

Considering the facts, nature of allegation, the fact that the petitioner has previous antecedent and the investigation is pending, this Court is not inclined to grant bail to the petitioner. 7.
