PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, for the issuance of Writ of Mandamus, directing the 2nd and 4th respondent to return the original certificates submitted to them at the time of admission.

ORDER
The present writ petition has been filed seeking direction to direct the 2nd and 4th respondent to return the original certificates submitted to them at the time of admission.
2. The learned counsel for the petitioner would submit that the petitioner joined in the Post Graduate course in the year 2018 and has completed his course in the month of September 2021. The specific contention of the petitioner is that according to the bond executed by the petitioner, he has to do two years bond service and the two years period ends on September 2023, however, until September 2023, no posting 2/5
orders were issued by the respondent, hence, the petitioner is entitled to get back his certificates.
3. The learned counsel for the petitioner would also invite the attention of this Court about the letter dated 28.11.2023 issued by Directorate of Medical Education/2nd respondent to the Dean-4th respondent, to act upon as per the instructions in the Office Ref.No.91027/ME2/1/2023 dated 25.09.2023.
4. Per contra, the learned Government Advocate would fairly submit that until now, no posting order had been issued to the petitioner.

In view of the above submission, it is amply clear that the two years bond period has comes to an end in September 2023, and the compulsory posting order must be within the above period, as the bond service is co-extensive with that of the bond period, and that having the respondent failed to give such posting order within the bond period, the petitioner is entitled to get back his original certificates. 3/5
6. In the light of the above reasoning, this writ petition is allowed. The 4th respondent is directed to return the original certificates submitted to them at the time of admission within a period of two weeks from the date of receipt of a copy of this order.
