[Order of the Court was made by M.SUNDAR, J.,] In the captioned matter, a notice under Section 6 of 'the Tamil Nadu Land Encroachment Act, 1905 (Tamil Nadu Act III of 1905)' [hereinafter 'said 1905 Act' for the sake of brevity, convenience and clarity] has been assailed.

2.When the matter was taken up, Mr.C.Prabakaran, learned counsel for writ petitioner sought leave of this Court to withdraw captioned 'Writ Petition' ['WP' for the sake of brevity] but made a plea to preserve all the rights and contentions of the writ petitioner and more particularly, preserve the contentions of the writ petitioner vide response dated 07.10.2024, saying so, learned counsel has made an endorsement in the case file and a scanned reproduction of the same is as follows:

3. In the light of the narrative thus far, captioned WP is disposed of as closed/withdrawn albeit with preservation of rights and contentions in the aforesaid manner. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
