Respondents Prayer:- Writ petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1 and 2 respondent to consider he claim of the petitioner for promotion as Director of Collegiate Education in the light of her representation dated 04.12.2019 as promote her as such with retrospective effect from 01.08.2019. O R D E R

This writ petition has been filed for a writ of mandamus, directing the 1st and 2nd respondent to consider the claim made by the petitioner seeking for promotion as Director of Collegiate Education.

2.It is the case of the petitioner that he is entitled to be considered for the promotion for the Post of Director of Collegiate Education and that the incumbent had already attained the age of superannuation on 31.05.2019. In that place, the 3rd respondent has now been given the charge as a Director of Collegiate Education, as a stop gap arrangement. According to the petitioner, a panel for promotion should be prepared and the promotion must be finalised. 3.It is further stated that the Government of Tamil Nadu has initiated the process for preparing the panel for promotion to the Post of Director of Collegiate Education in the month of June 2019, and the petitioner has already submitted her self Assessment Report. The grievance of the petitioner is that the process is kept pending for the last six months, and the 3rd respondent is made to continue as an incharge Director of Collegiate Education. Therefore, left with no other option, the present writ petition has been filed before this Court.

4.Heard Mr.AR.L.Sundaresan, learned Senior Counsel appearing on behalf of the petitioner and Mr.V.Kadhirvel, learned Special Government Pleader appearing for 1st and 2nd respondent and Mr.L.Chandrakumar, learned counsel appearing on behalf of the 3rd respondent.

5.Taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to the 1st respondent to consider the claim made by the petitioner for promotion as Director of Collegiate Education, and pass appropriate orders within a period of six weeks from the date of receipt of copy of this order.

This writ petition is disposed of with the above directions. No costs.

Consequently, the connected miscellaneous petition is closed.
